1. Agreement to Terms
By accessing and using Gaaust's software-as-a-service platform ("Service"), you accept and agree to be bound by the terms and provisions of this agreement. These terms apply to you as a customer ("Customer") of our Service.
2. Description of Service
Gaaust provides a privacy-first tracking script that Customers can install on their websites to collect and analyze visitor analytics. The Service collects the following types of information:
- Page analytics: Page URLs, page titles, and referrer sources
- Technical information: User agent strings (browser and device information), browser language settings
- Behavioral data: Page view timestamps and visit duration
- Content data: HTML body content of visited pages for content analysis
- Anonymous session identifiers: Temporary hashes generated from IP addresses and user agents combined with a daily-rotating cryptographic salt. Original IP addresses are never stored - they are used only momentarily to generate the hash and then immediately discarded.
Privacy by Design: Our Service does not use cookies or localStorage on visitors' devices. We do not store IP addresses or any personally identifiable information. Session identifiers are cryptographically hashed with a salt that changes daily, making it impossible to track individuals across days or re-identify visitors from stored data. User agent information is stored for aggregate browser and device statistics.
3. Customer Responsibilities
Customer is responsible for their use of the Service and must ensure that their use complies with all applicable laws and regulations in their jurisdiction. Customer is solely responsible for:
- The lawful collection and use of analytics data through the Service
- Ensuring their website's privacy policy accurately describes data collection practices (if required by their jurisdiction)
- Compliance with applicable privacy laws in their region and for their specific audience
Note on Cookie Consent: Because our Service does not use cookies, localStorage, or store personal data, it is designed to be compliant with GDPR and ePrivacy Directive without requiring cookie consent banners in most jurisdictions. However, Customer should consult with legal counsel to determine their specific obligations based on their location and audience.
4. Data Ownership and Usage
Customer retains ownership of all analytics data collected through the Service. By using the Service, Customer grants Gaaust a limited license to host, store, and process the collected data as necessary to provide the Service. Gaaust will not use Customer's data for any purpose other than providing and improving the Service, except with Customer's explicit consent or as required by law.
All data is anonymized and aggregated. We do not sell, rent, or share Customer data with third parties for advertising or marketing purposes.
5. Data Security and Retention
Gaaust implements industry-standard security measures to protect data collected through the Service, including:
- End-to-end TLS/HTTPS encryption for all data in transit
- Secure data storage with access controls and authentication
- Regular security audits and updates
- Automatic deletion of cryptographic salts after 24 hours, making historical data permanently anonymized
Analytics data will be retained according to Customer's subscription plan settings. Upon termination of the Service, Customer's data will be deleted within 730 days unless Customer requests earlier deletion or legal obligations require retention. Customer may export their analytics data at any time through the dashboard.
6. Subscription and Payment
Some aspects of the Service are billed on a subscription basis. You agree to pay all fees associated with your subscription plan. Fees are non-refundable except as required by law or as explicitly stated in these terms. We reserve the right to modify our pricing at any time, but changes will not affect existing subscription periods. Usage limits may apply based on your subscription tier.
7. Service Usage and Limitations
You agree to use the Service only for lawful purposes and in accordance with these terms. You are responsible for maintaining the security of your account and for all activities that occur under your account. You agree not to:
- Use the Service in any way that violates applicable laws or regulations
- Attempt to gain unauthorized access to the Service or related systems
- Interfere with or disrupt the Service or servers connected to the Service
- Use the Service to store or transmit malicious code or data
- Share your account credentials with others
- Reverse engineer, decompile, or attempt to extract the source code of the Service
- Remove or obscure any proprietary notices from the Service
- Use the Service for any commercial purposes beyond your subscription scope
- Attempt to re-identify anonymized visitors or circumvent privacy protections
8. Service Availability and Support
We strive to provide 99.9% uptime for the Service. However, we do not guarantee uninterrupted access to the Service. Scheduled maintenance will be communicated in advance when possible. We provide support through our help center and support channels as specified in your subscription plan.
9. Intellectual Property
The Service, including all content, features, functionality, tracking scripts, and analytics algorithms, is owned by Gaaust and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. Customer is granted a limited, non-exclusive, non-transferable license to use the Service during the subscription period. You may not copy, modify, distribute, sell, or lease any part of our Service without our written permission.
10. Third-Party Services
The Service may integrate with or utilize third-party services and infrastructure providers to deliver functionality. Gaaust is not responsible for the performance or availability of third-party services. A list of service providers may be provided upon request.
11. Indemnification
Customer agrees to indemnify and hold harmless Gaaust from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Customer's breach of these Terms of Service
- Customer's violation of any applicable laws or regulations
- Any misuse of the Service by Customer
- Claims by third parties related to Customer's use of the Service
12. Termination
Either party may terminate this agreement with 30 days' written notice. Gaaust may terminate or suspend Customer's access to the Service immediately if Customer breaches these terms. Upon termination:
- Customer's right to use the Service will immediately cease
- Customer must remove all tracking scripts from their websites
- Gaaust will delete Customer data according to Section 5
- No refunds will be provided for prepaid subscription fees unless required by law
13. Limitation of Liability
To the maximum extent permitted by law, Gaaust shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from Customer's use or inability to use the Service, including but not limited to loss of profits, data, or business opportunities. Gaaust's total liability for any claims under these terms shall not exceed the amount paid by Customer to Gaaust in the 12 months preceding the claim.
14. Warranty Disclaimer
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. Gaaust does not guarantee that the Service will be error-free, secure, or uninterrupted. Customer is responsible for evaluating whether the Service meets their requirements.
15. Changes to Terms
We reserve the right to modify these terms at any time. We will notify Customer of any material changes via email or through the Service at least 30 days before the changes take effect. Customer's continued use of the Service after such modifications constitutes acceptance of the modified terms. If Customer does not agree to the modified terms, Customer may terminate the agreement in accordance with Section 12.
16. Governing Law
These terms shall be governed by and construed in accordance with the laws of Delaware, without regard to its conflict of law provisions. Any disputes arising from these terms or the Service shall be resolved through binding arbitration in Delaware, except that either party may seek injunctive relief in court to protect intellectual property rights.
17. Miscellaneous
If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full effect. Gaaust's failure to enforce any right or provision of these terms will not be deemed a waiver. These terms constitute the entire agreement between Customer and Gaaust regarding the Service. No amendment to these terms shall be effective unless in writing and signed by both parties.
